TERMS AND CONDITIONS FOR NEW REALTORS
These Terms and Conditions (“Terms”) govern the relationship between the brokerage (“Brokerage”) and the real estate associate (“Agent”). By affiliating with the Brokerage, the Agent agrees to comply fully with the following terms:
INDEPENDENT CONTRACTOR STATUS
The Agent is an independent contractor and not an employee of the Brokerage. The Brokerage does not withhold taxes, provide benefits, or assume responsibility for the Agent’s personal expenses, insurance, or licensing obligations.
LICENSING & COMPLIANCE
The Agent must maintain an active and valid real estate license in good standing at all times. The Agent agrees to comply with all federal, state, local, MLS, Realtor Association, and Brokerage rules, regulations, policies, and ethical standards.
COMMISSIONS & COMPENSATION
Commission splits, caps, fees, and payment schedules are governed by the Brokerage’s current commission agreement and may be amended with notice. Commissions are paid only after a transaction has successfully closed and funds have been received by the Brokerage.
TRANSACTION PROCEDURES
All listings, contracts, offers, and transaction documents must be submitted through the Brokerage’s approved systems and within required timelines. Failure to comply may result in delayed commissions, administrative penalties, or disciplinary action.
BROKERAGE BRAND & MARKETING
The Agent may use the Brokerage’s name, logo, and branding only in accordance with brand guidelines. Unauthorized use, alteration, or misrepresentation of the brand is strictly prohibited. All advertising must comply with state law and Brokerage approval requirements.
CONFIDENTIALITY
The Agent agrees to maintain strict confidentiality regarding client information, Brokerage systems, trade secrets, pricing structures, marketing strategies, and internal processes during and after affiliation.
TECHNOLOGY & SYSTEMS
Access to Brokerage technology platforms, CRM systems, and tools is provided for business purposes only. The Agent is responsible for proper use, data integrity, and compliance with all privacy and cybersecurity policies.
FEES & EXPENSES
The Agent is responsible for all personal business expenses, including but not limited to MLS dues, Realtor Association fees, marketing costs, insurance, licensing renewals, continuing education, and technology fees unless otherwise specified in writing.
CONDUCT & PROFESSIONALISM
The Agent must conduct business professionally, ethically, and in a manner that protects the Brokerage’s reputation. Any conduct deemed harmful, unethical, or illegal may result in immediate termination.
OWNERSHIP OF FILES & RECORDS
All transaction files, listings, contracts, and records are the property of the Brokerage and must remain accessible upon request, even after termination.
NON-SOLICITATION (IF APPLICABLE)
During affiliation and for a defined period after termination (as permitted by law), the Agent agrees not to solicit the Brokerage’s active clients, agents, or employees for competing services.
TERMINATION
Either party may terminate this relationship in accordance with Brokerage policy. Outstanding transactions at the time of termination will be handled per the commission agreement and applicable law.
NO GUARANTEE OF INCOME
The Brokerage does not guarantee income, leads, transactions, or production. The Agent acknowledges that success depends on individual effort, market conditions, and compliance with Brokerage systems.
INDEMNIFICATION
The Agent agrees to indemnify and hold harmless the Brokerage from any claims, damages, or liabilities arising from the Agent’s actions, omissions, or violations of law.
MODIFICATIONS
The Brokerage reserves the right to update these Terms with written notice. Continued affiliation constitutes acceptance of any modifications.
GOVERNING LAW
These Terms are governed by the laws of the state in which the Brokerage operates.
